Terms of Service

These Terms of Service (“Terms”) govern your use of Tatv.Zoomi, operated by Tattva Energy Fintech LLP (LLPIN AAQ-8419), registered office B-108, Sarvodaya Enclave, New Delhi 110017, India (“Tatv.Zoomi”, “we”, “us”). By creating an account or using the Platform, you agree to these Terms and to our Privacy Policy.

1. Eligibility

You must be 18 years or older and able to form a binding contract. Drivers must additionally hold a valid driving licence, vehicle registration, permits, and insurance required by law, and must pass our verification.

2. What Tatv.Zoomi is

Tatv.Zoomi is a technology platform and aggregator that connects independent drivers with riders seeking transportation. We do not provide transportation services ourselves and are not a taxi operator or carrier. The transportation is provided by independent third-party drivers. We facilitate booking, fare calculation, payments, safety tools, and quality standards.

3. Your account

You are responsible for the accuracy of your information and for activity under your account. Log in is via a one-time code sent to your email, SMS, or WhatsApp. Keep your device and account secure and notify us of any unauthorised use.

4. Rider terms

• Booking & fares: fares are shown before you confirm and are based on distance, time, vehicle class, applicable surge, taxes, tolls, and any fees. Final fare may vary if the route or stops change.
• Payment: you authorise us (and our payment partners) to charge your selected method (UPI, card, or cash as offered). The rider app is free to use; you pay only per ride.
• Cancellations: a cancellation fee may apply if you cancel after a driver has been assigned or has arrived, per the cancellation policy shown in-app.
• Conduct: treat drivers and vehicles with respect, follow safety laws (including seatbelts), and do not carry illegal or hazardous items.
• Ratings: riders and drivers rate each other to keep the community safe and high-quality.

5. Driver terms

• Independent contractor: drivers are independent contractors, not employees of Tatv.Zoomi. You control when and whether you go online.
• Subscriptions & commission: drivers may subscribe to a plan (daily, weekly, monthly, quarterly, or yearly). Subscribed drivers keep 100% of the fare (excluding applicable taxes and payment-processing fees) and pay no per-ride commission. Drivers without an active subscription pay a per-ride commission at the rate shown in-app for their city. Subscription prices, benefits, renewal, and refund terms are presented at purchase.
• Cleanliness compliance: drivers must complete the mandatory vehicle-cleanliness check after every 2 hours of ride time, and after returning online following a gap of more than 2 hours. Failing or skipping a required check may pause your ability to accept rides until completed.
• Vehicle & documents: you must keep your licence, registration, permits, and insurance valid, and your vehicle roadworthy, clean, and as represented.
• Payouts: earnings, less any commission and applicable taxes, are paid out per the schedule and method shown in the driver app.

6. Safety

The Platform provides safety features including an in-app emergency (SOS) action and live trip sharing. In an emergency, contact local authorities directly (dial 112). You agree not to misuse safety features.

7. Payments, taxes & refunds

Prices are in Indian Rupees and include or add applicable taxes (e.g., GST) as required by law. Refunds, where applicable, are handled per the policies shown in-app and through the original payment method. Tax invoices are issued by Tattva Energy Fintech LLP (GSTIN 07AAPFT6421R1ZC) as applicable.

8. Prohibited conduct

• Using the Platform for anything unlawful, fraudulent, or unsafe.
• Harassing, discriminating against, or endangering any rider or driver.
• Tampering with location/GPS, creating fake accounts or trips, or manipulating fares, ratings, or subscriptions.
• Reverse-engineering, scraping, or disrupting the Platform.

9. Intellectual property

The Tatv.Zoomi name, logo, app, and content are owned by Tattva Energy Fintech LLP and may not be used without permission. You receive a limited, revocable, non-transferable licence to use the app for its intended purpose.

10. Disclaimers

The Platform is provided “as is” and “as available”. We do not guarantee that a driver or ride will always be available, or that the service will be uninterrupted or error-free. As an aggregator, we are not responsible for the acts or omissions of independent drivers or riders, but we will act in good faith on safety and quality reports.

11. Limitation of liability

To the maximum extent permitted by law, Tatv.Zoomi and Tattva Energy Fintech LLP shall not be liable for indirect, incidental, special, or consequential damages. Our total liability for any claim relating to a trip shall not exceed the amount paid for that trip. Nothing in these Terms limits liability that cannot be limited under applicable law.

12. Indemnity

You agree to indemnify Tatv.Zoomi against claims arising from your breach of these Terms, your misuse of the Platform, or your violation of law or the rights of others.

13. Suspension & termination

We may suspend or terminate access for breach of these Terms, fraud, safety risks, or as required by law. You may stop using the Platform and request account deletion at any time.

14. Governing law & disputes

These Terms are governed by the laws of India. Subject to applicable consumer-protection law, the courts at New Delhi shall have exclusive jurisdiction. We encourage you to contact us first to resolve any dispute amicably.

15. Changes

We may update these Terms. Continued use after changes take effect constitutes acceptance. The “Last updated” date reflects the current version.
